AGATEPORT RENTALS – TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of the Agateport Rentals website and your submission of booking requests to Agateport LLC (“Agateport Rentals,” “Company,” “we,” “us,” or “our”).

By accessing this website, submitting a booking request, or using our services, you agree to these Terms and any additional terms contained in the Motor Vehicle Rental Agreement you sign before taking possession of a rental vehicle.

1. BOOKING REQUESTS & APPROVAL

Submitting a booking request does not guarantee a reservation or vehicle availability.

All rentals are subject to availability, identity and document verification, driver eligibility, insurance verification, payment, and final approval by Agateport Rentals.

Agateport Rentals reserves the right to approve or decline a rental request when rental requirements are not satisfied or required information cannot be verified.

2. DRIVER ELIGIBILITY

The primary renter and all authorized drivers must be at least 25 years old, possess a valid driver's license, satisfy Agateport Rentals' driver eligibility requirements, and meet all other requirements contained in the applicable Motor Vehicle Rental Agreement.

Agateport Rentals may review driving history and may decline a rental based on driving history or failure to satisfy rental requirements.

3. INSURANCE

Renters must provide proof of valid automobile insurance meeting applicable financial responsibility requirements unless Agateport Rentals expressly agrees otherwise in writing.

Insurance requirements and the renter's financial responsibility for the vehicle are governed by the Motor Vehicle Rental Agreement applicable to the rental.

4. PAYMENT & SECURITY DEPOSIT

Required rental charges and the applicable security deposit must be paid before the vehicle is released to the renter.

Security deposits may be applied toward amounts owed under the Motor Vehicle Rental Agreement, including qualifying damage, loss, cleaning, smoking violations, fuel shortages, towing, storage, loss of use, diminished value, administrative charges, recovery expenses, and other amounts properly due under the agreement.

The renter remains responsible for amounts properly owed that exceed the security deposit.

5. CANCELLATIONS

Renters must provide at least 48 hours' notice before the scheduled rental start date and time to cancel and remain eligible for a refund of the security deposit.

Cancellations made less than 48 hours before the scheduled rental start date and time may result in forfeiture of the security deposit, subject to the applicable Motor Vehicle Rental Agreement.

6. AUTHORIZED DRIVERS

Only the renter and drivers specifically approved by Agateport Rentals may operate the rental vehicle.

Allowing an unauthorized driver to operate the vehicle constitutes a material breach of the Rental Agreement and may result in immediate termination of the rental.

A $500 Unauthorized Driver / Terminated Rental Fee may apply as provided in the Rental Agreement. The renter remains responsible for applicable rental charges, damages, recovery expenses, and other amounts due.

7. NO-SMOKING POLICY

All Agateport Rentals vehicles are strictly non-smoking. Smoking includes cigarettes, cigars, marijuana, vaping devices, e-cigarettes, and other combustible or vapor-producing substances.

Evidence of smoking may result in a $250 Smoking Fee PLUS forfeiture of the security deposit. The renter may also be responsible for additional cleaning, deodorizing, repair, or other costs as provided in the Rental Agreement.

8. MILEAGE

Unless otherwise stated in the applicable Rental Agreement, rentals include 150 miles per rental day.

Mileage exceeding the total permitted allowance is subject to a charge of $5.00 per additional mile. Mileage is determined using the vehicle's recorded starting and ending odometer readings.

9. FUEL

Rental vehicles must be returned with the same fuel level recorded at the beginning of the rental.

If a vehicle is returned below the required fuel level, the renter may be charged a $50 refueling service fee plus $5.00 per gallon required to restore the vehicle to the proper level, as provided in the Rental Agreement.

10. VEHICLE USE & TRAVEL

Unless Agateport Rentals provides prior written approval, rental vehicles may not be driven outside the State of Alabama or taken more than 150 miles from Mobile, Alabama.

Vehicles may not be used for illegal activity, racing or reckless driving, operated while the driver is under the influence of drugs or alcohol, used for unauthorized towing, or used for rideshare or delivery services unless specifically approved.

Prohibited use may result in termination of the rental and recovery or repossession of the vehicle.

11. DAMAGE, LOSS & ACCIDENTS

The renter's responsibility for damage, theft, loss, vandalism, loss of use, diminished value and other vehicle-related costs is governed by the applicable Motor Vehicle Rental Agreement.

Accidents, theft, damage, or significant vehicle issues must be reported to Agateport Rentals immediately. Renters must cooperate with applicable accident reporting, law-enforcement, and insurance-claim requirements.

12. LATE RETURNS & EXTENSIONS

Vehicles must be returned on or before the agreed rental end date and time unless an extension has been approved by Agateport Rentals.

A $100 Late Return Fee may apply in addition to additional rental charges.

A vehicle retained more than 24 hours beyond the agreed return time without authorization may be treated as an unauthorized holdover and may be subject to rental termination and vehicle recovery. A $350 Repossession/Recovery Fee may apply as provided in the Rental Agreement.

Extensions must be requested and approved before the scheduled return date and time.

13. TICKETS, TOLLS & VIOLATIONS

Renters are responsible for parking tickets, tolls, traffic citations, camera violations, fines, towing, impound charges, and similar assessments resulting from their possession or use of the vehicle.

An administrative fee may apply when Agateport Rentals is required to process a ticket, citation, toll, or violation, as specified in the applicable Rental Agreement.

14. PAYMENT AUTHORIZATION

Amounts properly owed under a signed Motor Vehicle Rental Agreement may be charged to an authorized payment method in accordance with the payment authorization provided by the renter, applicable law, and payment-network requirements.

Certain charges may not become known until after the vehicle is returned, including tolls, citations, damages, loss of use, fuel charges, or other amounts arising from the rental.

15. GPS TRACKING

Rental vehicles may contain GPS tracking technology. GPS information may be used for purposes identified in the applicable Rental Agreement, including theft recovery, late-return recovery, investigating contract violations, and unauthorized travel.

16. RENTAL AGREEMENT CONTROLS

These website Terms provide general information regarding Agateport Rentals' services and rental requirements. Every vehicle rental is subject to a separate Motor Vehicle Rental Agreement.

The renter must review and sign the applicable Rental Agreement before taking possession of a vehicle.

If these website Terms conflict with the signed Motor Vehicle Rental Agreement regarding a particular rental, the signed Motor Vehicle Rental Agreement will control to the extent permitted by applicable law.

17. WEBSITE INFORMATION

We attempt to keep vehicle availability, pricing, photographs, descriptions, and other website information accurate. However, availability may change, and website information does not constitute confirmation of a reservation.

18. GOVERNING LAW

These Terms and Agateport Rentals' services are governed by applicable law, including the laws of the State of Alabama, as applicable.

19. CHANGES TO THESE TERMS

Agateport Rentals may update these website Terms from time to time. Changes will be posted on this website with an updated effective date. Changes to website Terms do not retroactively modify a Motor Vehicle Rental Agreement already executed by the parties unless otherwise agreed or permitted by law.
